Terms of Use

The short version. Play fair, be kind to the people you're playing with, and have fun. Kazoo Pro is an optional auto-renewing subscription billed through Apple that you can cancel anytime in your Apple Account settings. Art tokens are consumable, never expire, and have no cash value. Your drawings stay yours. The AI's guesses and artwork are just for entertainment. The Apps are provided "as is."

These Terms of Use ("Terms") form an agreement between you and Octag AI LLC ("we," "us," or "our") governing your use of Kazoo Charades vs AI and Kazoo Sketch (each an "App," and together the "Apps"). By downloading or using either App, you agree to these Terms. If you don't agree, please don't use the Apps.

The Apps are two different games that share these Terms. In Kazoo Charades vs AI, you act out a word and the AI guesses through your front camera. In Kazoo Sketch, you draw on a canvas and Kazoo watches the canvas and guesses out loud — no camera, no microphone. Where a section below applies to only one App, we say so. Kazoo Sketch is now available on iPhone; these Terms apply to your use of the App.

The Apps and your license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Apps for your own non-commercial entertainment, in line with these Terms and the Apple App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or distribute the Apps except as allowed by law.

Both Apps are free to play, with no account and no sign-up — you play anonymously. The free tier is supported by ads.

Kazoo Pro subscriptions

Each App offers an optional auto-renewing subscription, Kazoo Pro. In Kazoo Charades vs AI, it unlocks premium decks, the Time Attack mode, and an ad-free experience. In Kazoo Sketch, it removes ads, unlocks all 17 themed decks, and unlocks Pro-only colour palettes.

Billing. Payment is charged to your Apple Account at confirmation of purchase. The plans and prices offered in each App — for Kazoo Charades vs AI, a weekly, monthly, or yearly basis — are shown in the App before you buy.
Auto-renewal. Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
Free trials. If a free trial is offered and you don't cancel before it ends, it automatically converts to a paid subscription. Any unused portion of a free trial is forfeited if you purchase a subscription.
Manage or cancel. Manage or cancel anytime in your Apple Account settings (Settings → your name → Subscriptions). Deleting an App does not cancel your subscription.
Each App is separate. A Kazoo Pro subscription applies to the App you bought it in. Subscribing in one App doesn't unlock the other.
Payments & refunds. Purchases are processed by Apple and are subject to Apple's terms; refunds are handled by Apple under its policies.

Art tokens and the Forge Kazoo Sketch

In Kazoo Sketch, the Forge sends one of your drawings to be re-rendered as art in a real style, and the result lands in your My Gallery. Each use of the Forge costs one art token.

What they are. Art tokens are a consumable in-app item — a limited licence to use a feature of the App, not property you own.
Getting them. You can buy art tokens in the App, or earn them free by watching a video.
They never expire. Unspent art tokens don't run out over time.
Once spent, they're gone. Art tokens are non-refundable once spent, including when a result isn't what you hoped for — the AI is generative, and its output varies.
No cash value. Art tokens have no monetary value and can't be transferred, sold, exchanged, or redeemed for cash or anything else outside the App.
Payments & refunds. Purchased tokens are charged to your Apple Account and processed by Apple; any refund of an unspent purchase is handled by Apple under its policies.

Acceptable use

Play fair and be kind. You agree not to misuse the Apps, interfere with their operation, bypass security or purchase requirements, or use them for any unlawful purpose. In camera modes, you're responsible for playing safely and being aware of your surroundings and the people around you when acting out words.

Online rooms and player conduct Kazoo Sketch

Kazoo Sketch Rooms let a host create an online room, share a 5-character code, and play with up to 10 players. What you draw and the name you choose are seen by everyone in the room, so keep it playable for the whole table.

Don't draw it if you wouldn't show it to the room. You agree not to create, send, or display drawings, names, or other content that is harassing, hateful, sexual, or illegal.
Report and Block. Both are available in-app on other players' artwork. Please use them — reports help us find what shouldn't be there.
Enforcement. We may remove content and suspend or ban users who break these rules or misuse Rooms. We may do this at our discretion and without notice.

Your drawings and content ownership

The drawings you make are yours. You keep the rights you already have in them, and we don't claim ownership.

To run the game, we need your permission to move your drawing around. You grant us a non-exclusive, worldwide, royalty-free licence to host, transmit, and display your drawings only as needed to operate the service — that is, to send them to the other players in your room, to process them so the AI can guess, and, if you choose to use the Forge, to process them to produce your art. That licence lasts only as long as we need it for those purposes, and it doesn't let us use your drawings to advertise or promote the Apps.

AI-generated content

Kazoo's guesses — whether it's watching you act or watching your canvas — are produced automatically by an AI model, as is any artwork produced by the Forge. All of it is generated, and it is provided for entertainment only, as-is. It may be wrong, unexpected, or imperfect, and shouldn't be relied on for any purpose beyond playing the game.

Camera and microphone

In Kazoo Charades vs AI, some modes use your front camera and/or microphone so the App can play — for example, so the AI can "see" you act or "hear" guesses. You control these permissions in your device Settings. Kazoo Sketch uses no camera and no microphone — Kazoo watches the canvas, not you. How information is handled in either App is described in our Privacy Policy.

Intellectual property

The Apps — including their names, the Kazoo mascot, design, text, graphics, word decks, and software — are owned by Octag AI LLC or its licensors and are protected by intellectual-property laws. These Terms don't grant you any rights in our trademarks or content beyond the limited license to use the Apps.

Disclaimers

The Apps are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Apps will be uninterrupted or error-free, that online rooms will always be available, or that AI guesses or generated artwork will be accurate or meet your expectations.

Limitation of liability

To the fullest extent permitted by law, Octag AI LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Apps. Our total liability for any claim relating to the Apps will not exceed the amount you paid us in the 12 months before the claim (or, if you paid nothing, USD $50).

Indemnification

You agree to indemnify and hold harmless Octag AI LLC from claims, damages, and expenses arising out of your misuse of the Apps, the content you create or share in them, or your violation of these Terms.

Changes to the Apps and these Terms

We may update, change, or discontinue parts of the Apps at any time. We may also update these Terms; when we do, we'll revise the "Last updated" date. Continued use after changes means you accept the updated Terms.

Termination

You may stop using the Apps at any time. We may suspend or end your access if you violate these Terms or misuse the Apps.

Apple App Store

You acknowledge that these Terms are between you and Octag AI LLC only — not Apple — and that Apple is not responsible for the Apps or their content. Your license to use the Apps is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. Octag AI LLC, not Apple, is solely responsible for the Apps and for any maintenance and support. If an App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Octag AI LLC, not Apple, is responsible for addressing any claims relating to the Apps (including product-liability, legal or regulatory, and intellectual-property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the United States and the state in which Octag AI LLC is organized, without regard to conflict-of-laws rules. Disputes will be handled in the courts located there, unless applicable law provides otherwise.
